Real Estate
Foreclosure Relief
Obviously this is an issue that comes up every single day at TLF. We can help. Not everyone qualifies. But if your facts are right you may be eligible to file a lawsuit that can stop the foreclosure of your home and provide you with both the time and the leverage to get your creditor to pay attention and work things out.
The basics are this: Your mortgage is a contract. The bank needs to act fairly and in good faith. If they do not they are violating the terms of that contract. We file lawsuits against banks for fraud, wrongful foreclosure, unfair and deceptive business practices and various other causes of action as they apply to each individual case. We then file an emergency application with the court asking for a temporary restraining order (TRO) instantaneously stopping the foreclosure sale. That usually gets the bank's attention.
Have you been getting the run around from your lender? Have you been getting passed down the line? Are you sick and tired of being ignored and lied to? Do they promise you one thing and then change things up? Do you feel like you are the victim of predatory lending practices? We can definately help.
There are no guarantees when you file a lawsuit. But TLF can give you the absolute best possible chance at stopping the foreclosure proceedings and getting the bank to negotiate in good faith for a restructuring, refinance or some other settlement. Call us today for a free consulation.
Other Real Estate Issues
Real estate law encompasses a wide array of issues. We can help. If you are thinking about buying or selling property then TLF will protect your interests by limiting your exposure and ensuring you obtain the full benefit of your bargain. We can draft all buy/sell agreements and arrange for everything from the first offers to closing through escrow.
Many real estate lawsuits come about because of poor drafting and execution. The best way to avoid litigation is to hire a litigator like TLF to negotiate and implement the real estate transaction you want. They say an ounce of prevention is worth a pound of cure. This adage is most true in real estate. This area of business is rife with schemers who will promise you everything and deliver nothing but economic loss and heartache. TLF has not seen it all. But Nicholas Tepper has been involved in real estate transactions since 1993 and he can and will ensure everything goes smoothly and that you are protected.
Buying and selling real estate is just a very small portion of the issues TLF helps its clients with. Is the property you are purchasing rent controlled and, if so, what does that mean for you as a potential purchaser? Perhaps you have received a citation from the city because a portion of your property contains some illegal building. We can help you with that as well. Here is a short list of some of the myriad of issues with which we can help:
- Rent control issues
- Nuisance problems
- Foreclosure issues for owners, renters and buyers
- Evictions
- Relocation fee claims
- Leases (residential and commercial)
- Rent increases/change in lease terms
- Tenant repair and deduct
- Estoppel certificates
- Land use and zoning
- City/County inspections and citations
- Trespass
- Restraining orders
- Constructive eviction
- Lawsuits for damages
Another very large portion of our practice is dedicated to lawsuits involving a tenant suing a landlord for uninhabitable living conditions. We represent both landlords and tenants in these cases. These types of cases typically involve a tenant who has some living condition issues which the landlord either is not fixing or has fixed in a way that does not fix the problem. For example, a roof collapse during the rainy season is a typical kind of case that ends up in court. In any event, TLF has substantial experience in these "habitability cases" and we would be happy to talk to you about your situation.
